Liftavi Terms of Service
Last updated
These Terms of Service ("Terms") are a contract between you and [Legal name], [Address], OIB / company registration number [OIB/company ID] ("we", "us"), for your use of Liftavi: the web app at app.liftavi.com, the Liftavi apps for Android and iOS, and the Liftavi API at api.liftavi.com (together, "Liftavi" or "the service").
Please read them carefully. By creating an account you accept these Terms. How we handle your personal data is explained in our Privacy Policy.
1. What Liftavi is
Liftavi asks about your goals, your body and how you train, and generates a personalised training plan and nutrition targets (for example calories, protein, carbohydrates and fat). You can log workouts and body weight and follow your progress. You can also try a preview plan without an account.
Plans are generated automatically by a rule-based algorithm from the answers you give. They are general estimates; their quality depends on the accuracy of your answers.
Liftavi is currently provided free of charge. [If paid features are introduced later, separate terms, prices and the statutory right of withdrawal will apply and be shown before purchase.]
2. Not medical advice — please read
Liftavi provides general fitness and nutrition information, not medical advice. Liftavi is not a medical device and is not intended to diagnose, treat, cure or prevent any disease or injury. Plans are estimates generated from your answers and may not suit everyone.
- Talk to a doctor or qualified professional before starting a new exercise or diet program — especially if you are pregnant or breastfeeding, have a medical condition, injury, eating disorder or heart, lung or joint problems, take medication, are recovering from surgery, or have not exercised for a long time.
- Stop any exercise immediately if it causes pain, dizziness, chest pain or shortness of breath, and seek medical help if needed.
- Entering an injury in Liftavi only lets the algorithm avoid or replace some exercises. It is not an assessment of your injury and does not make an exercise safe for you. Ask a doctor or physiotherapist.
- Calorie and nutrient targets are estimates. Do not follow aggressive diets without professional supervision.
- Use correct technique and appropriate weights, warm up, and train within your abilities. If you are under 18, train with qualified supervision.
You decide whether and how to follow a plan, and you are responsible for training safely.
3. Who can use Liftavi
You must be at least 16 years old to create an account and use Liftavi. By creating an account you confirm that you are. You may only create an account for yourself and only one account.
4. Your account
- Give accurate information and keep it up to date — the plan depends on it.
- Keep your password secret and do not share your account. Use a password you do not use elsewhere.
- Tell us at privacy@liftavi.com without delay if you think someone else has access to your account. You can sign out all devices and change your password in your Profile.
- To use the personalised features you must give your explicit consent to the processing of your health data (see the Privacy Policy). You can withdraw it at any time in your Profile; your health data is then deleted and the personalised features are unavailable until you consent again.
- We send you only service emails (email verification, password reset).
5. Acceptable use
You must not:
- use Liftavi in breach of the law or of anyone's rights;
- attempt to access other users' accounts or data, or our systems beyond what the app offers;
- probe, scan or test the security of Liftavi, or circumvent rate limits, authentication or other protections — if you find a vulnerability, please report it to [security contact, e.g. security@liftavi.com] instead;
- overload or disrupt the service, or access it with automated means (bots, scrapers) other than as an ordinary user of the apps and the documented API for your own account;
- copy, resell or commercially exploit the service, the exercise catalogue or generated plans, or reverse engineer the service except where the law expressly allows it;
- upload malware, or content that is unlawful, offensive or infringes others' rights (for example in workout notes).
6. Intellectual property
- Your content (your answers, workout logs, notes, weight entries) remains yours. You give us the right to store and process it only to provide Liftavi to you, as described in the Privacy Policy.
- Our content — the Liftavi software, plan algorithm, exercise catalogue and instructions, texts, design, logo, mascot and the name "Liftavi" — belongs to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable right to use Liftavi and the plans it generates for your own, non-commercial purposes for as long as you use the service.
7. Availability and changes to the service
We work to keep Liftavi available and reliable, but because it is a free service we cannot guarantee uninterrupted or error-free operation. We may carry out maintenance, which can cause short interruptions. We may change, improve or remove features. If we intend to discontinue Liftavi entirely, we will tell you at least [30] days in advance so you can download your data.
8. No warranty
To the extent permitted by law, Liftavi is provided "as is". We do not promise any particular result, such as weight loss, muscle gain or performance. This does not limit any statutory rights you have as a consumer that cannot be excluded by contract, including rights relating to the conformity of digital content and services where applicable.
9. Liability
- We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health caused by our fault, and wherever liability cannot be limited by law (for example under product liability law).
- For ordinary (slight) negligence we are liable only for breach of an obligation that is essential to the proper provision of the service and on whose fulfilment you may regularly rely, and then only for the typical, foreseeable damage. Otherwise we are not liable for slight negligence.
- Because Liftavi gives general information and not medical advice (section 2), we are not liable for consequences of following a plan that result from your health condition, from incorrect information you gave, or from ignoring the warnings in section 2 — except as set out in point 1.
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including Art. 345 of the Croatian Civil Obligations Act (Zakon o obveznim odnosima) or the mandatory consumer protection laws of your country of residence.
10. Termination
- You can stop using Liftavi at any time and delete your account in Profile → Delete account. Your data is then deleted as described in the Privacy Policy. Download your data first if you want to keep it.
- We may suspend or close your account if you seriously or repeatedly breach these Terms or the law, or if needed to protect other users or the service. Where reasonable we will warn you first and tell you the reason. We may also end the contract with at least [30] days' notice, for example if we discontinue Liftavi.
- Sections that by their nature should continue (for example 6, 9 and 12) survive termination.
11. Changes to these Terms
We may change these Terms for valid reasons, such as new features, changes in law or to improve security. We will tell you about material changes in the app (and, where appropriate, by email) at least [30] days before they take effect, unless a change is required by law sooner. You will be asked to accept the new version in the app. If you do not agree, you can delete your account at any time; you cannot continue to use the account features until you accept.
12. Governing law and disputes
- These Terms are governed by the laws of the Republic of Croatia, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another country, you also keep the protection of the mandatory provisions of the law of your country of residence (Art. 6(2) Rome I Regulation).
- Consumers may bring proceedings in the courts of their place of residence or in Croatia; we may sue consumers only in the courts of their place of residence. For non-consumers, the courts of [city, e.g. Zagreb], Croatia have jurisdiction.
- Out-of-court dispute resolution: [Owner to complete the consumer ADR information required by Croatian consumer protection law — name of the competent ADR body and whether we participate.] We are happy to resolve any issue first at the contact below.
13. Miscellaneous
- If a provision of these Terms is invalid, the rest remains in force.
- You may not transfer your rights under these Terms to someone else. We may transfer the contract to a successor operating Liftavi if your rights are not reduced; we will inform you in advance and you may delete your account.
- [These Terms are available in English and Croatian; in case of differences the [Croatian] version prevails. — owner to decide after translation.]
